শর্তাবলীঃ

১। গ্রাহকের পরিচয়, আইনগত অবস্থা এবং ব্যবসায়িক ক্ষমতা বিষয়ক প্রয়োজনীয় নথি এবং তথ্য গ্রাহককে সরবরাহ করতে হবে। কার্নিভাল ইন্টারনেটের অধিকার থাকবে সেগুলো যাচাই করে নেয়ার।

২। গ্রাহকদের দ্বারা কোনো নথিতে বা সাবস্ক্রিপশন ফর্মে সহ কোনো ভুল বা মিথ্যা তথ্য দেওয়ার হলে দুর্বার ইন্টারনেট অধিকার থাকবে অস্থায়ীভাবে সংযোগ বিচ্ছিন্ন করার, স্থগিত করার বা পরিষেবা বন্ধ করার। পূর্বে প্রদত্ত তথ্যে কোন পরিবর্তন হলে, গ্রাহক সে সম্বন্ধে দুর্বার ইন্টারনেট অবহিত করতে হবে। এর ব্যাত্যয় ঘটলে দুর্বার ইন্টারনেট নিজস্ব বিবেচনার ভিত্তিতে পরিষেবাগুলি স্থগিত বা বন্ধ করার অধিকার রাখবে।

৩। উভয় পক্ষই অঙ্গীকারবদ্ধ হবে যে, এক পক্ষের দ্বারা প্রাপ্ত যেকোনো গোপনীয় তথ্য অন্য পক্ষের দ্বারা গোপনীয় হিসাবে রাখা হবে। ইতিপূর্বেই পাবলিক ডোমেনে অবস্থান, গ্রহণকারীর কাছে আইনলঙ্ঘন না করেই পূর্ব হতে তথ্যের উপস্থিতি বা আইনী প্রয়োজনে এ ধরনের তথ্য প্রকাশ করা যেতে পারে।

৪। দুর্বার ইন্টারনেট কর্তৃক প্রদত্ত সংযোগ ও সরঞ্জামের (ONU, ওয়াইফাই রাউটার বা অন্য কিছু) শিরোনাম ও মালিকানার একচেটিয়া অধিকার এবং এখতিয়ার দুর্বার ইন্টারনেটর রয়েছে।

৫। নির্ধারিত সময়সীমার মধ্যে দুর্বার ইন্টারনেট কর্তৃক গ্রাহককে পরিষেবা প্রদান করতে হবে। অন্যথায়, কোনো প্রকার বিলম্বের ক্ষেত্রে, দুর্বার ইন্টারনেট কর্তৃক যত দ্রুত সম্ভব গ্রাহককে জানিয়ে দেয়া হবে।

৬। নিয়ন্ত্রণ বহির্ভূত কারণে সেবা বা সংযোগে সমস্যা, ব্যাঘাত বা বিচ্যুতি ঘটলে দুর্বার ইন্টারনেট দায়ী থাকবেনা।

৭। নিয়ন্ত্রণ বহির্ভূত কারণে বা মেরামত, রক্ষণাবেক্ষণ, উন্নয়ন কাজের জন্য দুর্বার ইন্টারনেট সাময়িকভাবে আংশিক বা সম্পূর্ণ সংযোগ বিচ্ছিন্ন করতে পারে। সেক্ষেত্রে, দুর্বার ইন্টারনেট কর্তৃক যত দ্রুত সম্ভব গ্রাহককে জানিয়ে দেয়া হবে।

৮। দুর্বার ইন্টারনেটের বরাদ্দকৃত সংখ্যক সংযোগ বা ব্যান্ডউইথ ক্ষমতার বাইরে দুর্বার ইন্টারনেটর দ্বারা প্রদত্ত যেকোন সংস্থানগুলিতে গ্রাহক ডিভাইস/টার্মিনাল/আইপি ব্যবহার করলে পরবর্তী বিজ্ঞপ্তি ছাড়াই সংযোগ স্থগিত বা বন্ধ করার অধিকার রয়েছে।

৯। গ্রাহক মাসিক ডেটা ভলিউম সীমা অতিক্রম করলে সংযোগটি স্বয়ংক্রিয়ভাবে দুর্বার ইন্টারনেট থেকে বিচ্ছিন্ন হয়ে যাবে।

১০। দুর্বার ইন্টারনেটের ট্রাফিক চার্জ, মেয়াদের মেয়াদ, প্যাকেজ প্ল্যান এবং অন্য কোন সম্মত শর্তাবলী ইত্যাদি পরিবর্তন/বাড়ানো/কমানোর একচেটিয়া অধিকার থাকা উচিত যে কোনো সময়ে এই ধরনের পরিবর্তনের অফিসিয়াল বিজ্ঞপ্তি সাপেক্ষে। কোনো নিয়ন্ত্রক বা সরকার আরোপের কারণে এই ধরনের পরিবর্তন ঘটলে কোনো বিজ্ঞপ্তির প্রয়োজন হবে না।

১১। দুর্বার ইন্টারনেট গ্রাহককে দুর্বার ইন্টারনেট পরিষেবা সম্পর্কে নতুন তথ্য সম্পর্কে আপডেট রাখতে পারে, যদি প্রয়োজন হয়। দুর্বার ইন্টারনেট তার যেকোনো অফার এবং পরিষেবা সম্পর্কিত যোগাযোগ এবং/অথবা ম্যাসেজ করার অধিকার সংরক্ষণ করে যে কোনো সময় এবং যেকোনো উপায়ে গ্রাহককে সময়ে সময়ে আপডেট রাখতে। দুর্বার ইন্টারনেট প্রচার বা ব্যবসায়িক উদ্দেশ্যে এর উপাদানে গ্রাহকের নাম ব্যবহার করার অধিকার সংরক্ষণ করে।

১২। দুর্বার ইন্টারনেট তার গ্রাহকদের সর্বোত্তম সম্ভাব্য পরিষেবা প্রদানের চেষ্টা করবে। তবে, গুণমান, নির্ভরযোগ্যতা এবং পরিষেবার প্রাপ্যতা বিভিন্ন কারণের উপর নির্ভর করতে পারে। উপরের যে কোনো কারণের কারণে কাঙ্ক্ষিত গুণমান, নির্ভরযোগ্যতা এবং পরিষেবার প্রাপ্যতা অর্জনে ব্যর্থ হলে, দুর্বারকে দায়ী করা হবে না।

১৩। গ্রাহক এমন কোনো বেআইনি কাজ করার জন্য দুর্বার ইন্টারনেট পরিষেবাগুলি ব্যবহার না করার অঙ্গীকার করেন যা জাতীয়, সামাজিক বা অর্থনৈতিক স্বার্থকে বিপন্ন করতে পারে বা অন্য গ্রাহকের কাছে দুর্বার ইন্টারনেটের সুনামকে ক্ষতিগ্রস্ত করতে পারে। এই ধরনের পরিস্থিতিতে, দুর্বার ইন্টারনেটের গ্রাহকদের পরিষেবা বন্ধ করার এবং উপযুক্ত আইনি ব্যবস্থা নেওয়ার একচেটিয়া অধিকার থাকবে। গ্রাহকের বেআইনি ব্যবহারের কারণে দুর্বার ইন্টারনেটের কোনো ক্ষতি, ক্ষতি হলে বা কোনো জরিমানা দিতে হলে গ্রাহক ক্ষতিপূরণ করবে।

১৪। এই চুক্তিতে যা কিছুই থাকুক না কেন, দুর্বার ইন্টারনেটের ব্রোশিওর, বিজ্ঞপ্তি, প্রকাশিত এবং/অথবা দুর্বার ইন্টারনেট দ্বারা সম্প্রচারিত তার পরিষেবা, পরিষেবার মূল্য, বিলিং নীতি, ক্রেডিট নীতি ইত্যাদির মাধ্যমে অন্য যেকোন তথ্যও এই চুক্তিতে বাধ্য হবে৷

১৫। দুর্বার ইন্টারনেট পরিষেবাগুলির ব্যবহার তার সর্বশেষ প্রযোজ্য ব্যবহার নীতির সাপেক্ষে৷

১৬। গ্রাহক দুর্বারকে তার নির্ধারিত বিল বিন্যাসে কঠোরভাবে নির্ধারিত তারিখের মধ্যে সম্মত চার্জ প্রদান করবেন। দুর্বার ইন্টারনেটের অধিকার আছে গ্রাহকের সাথে সংযোগ স্থগিত বা বন্ধ করার যদি বিলটি নির্ধারিত তারিখের মধ্যে সম্পূর্ণ পরিশোধ না করা হয়।

১৭। সংযোগ স্থানান্তরের জন্য গ্রাহকদের “শিফটিং চার্জ” দিতে হবে।

১৮। পেমেন্ট ডিফল্টের কারণে গ্রাহকের সংযোগ স্থগিত, সাময়িকভাবে বা স্থায়ীভাবে সংযোগ বিচ্ছিন্ন হলে গ্রাহক তার/তার বকেয়া সম্পূর্ণ অর্থ প্রদান করে তার সংযোগ পুনরায় স্থাপন করার অধিকারী হবেন। যদি দুর্বার ইন্টারনেটের দ্বারা সংযোগটি স্থায়ীভাবে বিচ্ছিন্ন হয়ে থাকে, তবে বকেয়া বিলের সম্পূর্ণ অর্থ প্রদানের সাথে, গ্রাহক প্রযোজ্য হলে পুনঃসংযোগ ফি দিতেও দায়বদ্ধ।

১৯। দুর্বার ইন্টারনেট গ্রাহককে দেওয়া সমস্ত অপটিক্যাল নেটওয়ার্ক সরঞ্জামের মালিকানা বজায় রাখবে। পরিষেবার সমাপ্তি বা সাময়িক বন্ধের ক্ষেত্রে, গ্রাহক কোনও বিলম্ব ছাড়াই দুর্বারে সরঞ্জামগুলি হস্তান্তর করবেন। সরঞ্জামের যে কোনও ক্ষতির জন্য, গ্রাহককে ক্ষতির সরঞ্জামের মূল্য ক্ষতিপূরণ দিতে হবে।

২০। দুর্বার ইন্টারনেটের কোনো তথ্যের নির্ভুলতা বা উপযুক্ততার উপর কোনো নিয়ন্ত্রণ নেই এবং গ্রাহক ইন্টারনেট ব্যবহারের জন্য সম্পূর্ণরূপে দায়ী।

২১। গ্রাহক সম্ভাব্য ক্ষতি (যেমন অপব্যবহার, অবহেলা, আগুন, বজ্রপাত, প্রাকৃতিক বিপর্যয়, চুরি, নাশকতা, পানির সংস্পর্শে আসা, উচ্চতা থেকে পড়ে যাওয়া) থেকে দুর্বার ইন্টারনেটের সরবরাহ করা সরঞ্জামগুলিকে রক্ষা করার দায়িত্ব নেয়। দুর্বার ইন্টারনেটের অধিকার থাকবে গ্রাহকের কাছ থেকে ক্ষতিপূরণ চাওয়ার।

২২। পরিষেবা এবং সরঞ্জামগুলির ব্যবহার বা অপব্যবহারের কারণে অন্যথায় সৃষ্ট কোনও স্বাস্থ্যগত ঝুঁকি বা সমস্যার জন্য দুর্বার ইন্টারনেট দায়বদ্ধ হবে না।

২৩। গ্রাহক তার নিজের এবং তার গ্রাহকের অবৈধ ডেটা বা ভয়েস ট্রান্সফার বা ট্রাফিক বা বাল্ক ই-মেইল স্প্যামিং বা অন্য কোন অবৈধ ক্রিয়াকলাপের জন্য সম্পূর্ণরূপে দায়ী থাকবে। বাল্ক ই-মেইল স্প্যামিং পাঠানো কঠোরভাবে নিষিদ্ধ এবং গ্রাহক অ্যাকাউন্ট অবিলম্বে বন্ধ করা হবে। গ্রাহকের বেআইনি ব্যবহারের কারণে দুর্বার ইন্টারনেটের কোনো ক্ষতি হলে বা কোনো জরিমানা দিতে হলে গ্রাহক ক্ষতিপূরণ করবে।

২৪। গ্রাহক তার প্রাঙ্গনে এবং তার চুক্তিতে যথাযথ বৈদ্যুতিক সংযোগ, পাওয়ার গ্রাউন্ডিং ইউপিএস, স্টেবিলাইজার ইত্যাদি ইনস্টল করবেন। গ্রাহক দুর্বার ইন্টারনেটের অনুমতি ব্যতীত দুর্বার ইন্টারনেটের দ্বারা প্রদত্ত কোনও সরঞ্জাম স্থানান্তর বা সরাতে পারবেন না।

২৫। এই নথির স্বাক্ষরকারী এবং দুর্বার ইন্টারনেটের অনুমোদিত প্রতিনিধি এবং দুর্বার ইন্টারনেটের রাজস্ব নিশ্চয়তা বিভাগ থেকে ছাড়পত্র ছাড়া দুর্বারে কোনো পণ্য/সেবা ইনস্টল করা যাবে না।

২৬। ব্যান্ডউইথের কোনো আপগ্রেড/ডাউনগ্রেড বা অন্য কোনো পরিবর্তনের জন্য গ্রাহকদের লিখিত অনুরোধ/সম্মতি ছাড়া কার্যকর করা হবে না। ব্যান্ডউইথ বাড়ানো/কমানোর জন্য, অস্থায়ীভাবে/স্থায়ীভাবে সংযোগ বিচ্ছিন্ন করার জন্য এক মাস আগে লিখিত নোটিশ প্রয়োজন।

২৭। গ্রাহক গ্রাহক কাস্টমার কেয়ারে দুর্বার ইন্টারনেটের পরিষেবা সম্পর্কে তার অভিযোগ দায়ের করবেন।

২৮। গ্রাহক লিখিত অনুমতি ছাড়া দুর্বার ইন্টারনেট পরিষেবাগুলি পুনঃবিক্রয় করার জন্য অনুমোদিত নয় এবং যদি গ্রাহককে এটি করতে পাওয়া যায় তবে আইনি ব্যবস্থা নেওয়ার জন্য দায়ী থাকবে৷

২৯। বাংলাদেশের সশস্ত্র বাহিনীর ভেটেরান্সরা তাদের মাসিক চার্জে ২৫% কম অর্থপ্রদান উপভোগ করতে পারবেন বাংলাদেশের স্বাধীনতার সুবর্ণ জয়ন্তীতে দুর্বার ইন্টারনেট ইন্টারনাল থেকে শ্রদ্ধা হিসেবে তাদের আজীবন জাতির সেবা করার জন্য! এই অফারটি পেতে, অভিজ্ঞদের নিবন্ধন বা অনলাইন কেনাকাটার সময় তাদের বৈধ TS নম্বর জমা দিতে হবে। দুর্বার ইন্টারনেটের সাথে তাদের বাড়িতে সংযোগ করার সময় আমাদের পরিষেবা সরবরাহকারী দল টিএস নম্বর সহ অভিজ্ঞদের আইডির ফটোকপি সংগ্রহ করবে। অভিজ্ঞদের আইডি কার্ডের ফটোকপি বিশেষভাবে দেওয়া সুবিধা সক্রিয় করার জন্য একটি অপরিহার্য নথি। ভেটেরান্সরা তাদের ভাড়াটেদের কাছেও এটি উল্লেখ করতে পারেন যেখানে ভেটেরান্সদের দ্বারা যথাযথভাবে স্বাক্ষরিত একটি সুপারিশ পত্র এবং অভিজ্ঞ আইডির ফটোকপিও একটি অপরিহার্য নথি হিসাবে বিবেচিত হবে। দুর্বার ইন্টারনেট একচেটিয়াভাবে যেকোনো সময় যেকোনো অফার প্রত্যাহার করার অধিকার সংরক্ষণ করে।

৩০। দুর্বার ইন্টারনেটের দায়িত্বগুলি এই চুক্তিতে উপরে যেমন স্পষ্টভাবে বলা হয়েছে এবং দুর্বার ইন্টারনেট এই চুক্তিতে থাকা ব্যক্তিদের ছাড়া অন্য কোনো দায়িত্ব নেয় না।

৩১। এখানে উল্লেখিত শর্তের বিপরীত কিছু সত্ত্বেও, দুর্বার ইন্টারনেট কোনো কারণ বা কোনো প্রতিনিধিত্ব, উহ্য ওয়্যারেন্টি বা শর্ত বা অন্য মেয়াদের জন্য দায়বদ্ধ হবে না, আইনসম্মতভাবে বা এই চুক্তির শর্তাবলীর অধীনে কোনো ক্ষতির জন্য, ক্ষতি/লাভ, প্রকৃত বা ফলস্বরূপ বা অন্যথায় এবং দুর্বার ইন্টারনেট বা এর কর্মচারী বা এজেন্টদের দ্বারা বা অন্যথায় পণ্য বিক্রয় এবং/অথবা গ্রাহকের কাছে পরিষেবার বিধান সম্পর্কিত।

৩২। দুর্বার ইন্টারনেট উপরোক্ত শর্তাবলী পরিবর্তন করার অধিকার সংরক্ষণ করে।

Subscriber has to provide necessary documents and information to establish subscriber’s identification, legal status and business capacity. Durbar shall have the right to examine the same.
Durbar shall have the right to temporary disconnect, suspend or terminate the services for giving any false information by the subscriber in any document or otherwise including on the subscription form. If there is any change in the information given earlier, Subscriber shall notify Durbar of such change, failure of which shall entitle Durbar to suspend or terminate the services and its sole discretion.
Both parties undertake that any information received by one party marked as confidential shall be kept as confidential by the other party. Such information can be revealed if it is found that it was already in the public domain or it was already available to the receiving party without violating this agreement or if it is required by law.
Durbar has the exclusive right and jurisdiction of the title and ownership of the connection and equipment (ONU & Wifi Router or any other) provided by Durbar.
Durbar shall provide the services to the subscriber within agreed timeline. However, in case of any delay, Durbar will notify the subscriber as soon as it is reasonably practicable.
Durbar shall not be liable for disruption and discontinuation of its service due to any disturbance, congestion, severance in the other networks reasons beyond its control.
Durbar may temporarily suspend the services wholly or in parts for repair, maintenance, upgrading or circumstances beyond Durbar control. However, Durbar will notify the subscriber as soon as it is reasonably practicable.
Durbar have the right to suspend or terminate the connection without further notice in case of subscriber uses the device/ terminal/ IP on any resources provided by Durbar beyond the allocated number of connections or bandwidth capacity.
The connection will be automatically disconnected from Durbar if the subscriber has exceeded the monthly data volume limit.
Durbar should have exclusive right to change/ increase/ reduce the traffic charges, validity period, package plans and any other agreed terms etc. at any time subject to official notification of such changes. No notification will require if such changes take place due to any regulatory or government imposition.
Durbar may keep the subscriber updated about any new information about the Durbar services, if needed. Durbar reserves the right to communicate any of its offer and services related communication and/or massage to the subscriber at any time and in any manner to keep the subscriber updated from time to time. Durbar reserves the right to use the name of the subscriber in its material for promotion or business purpose.
Durbar shall endeavor to provide the best possible service to its subscribers. However, the quality, reliability and the availability of service may dependent on various factors. In case of failure to achieve desired quality, reliability and the availability of service due to any of the above factors, Durbar shall not be held liable.
The subscriber undertakes not to use Durbar services to commit any unlawful act which might endanger national, social or economic interest or damage Durbar reputation to other subscriber. Under such circumstances, Durbar shall have the exclusive right to discontinue the services of the subscriber and take appropriate legal measures. Subscriber shall indemnify Durbar if it suffers any losses, damages or has to pay any penalty due to unlawful usage of the subscriber.
Notwithstanding anything contained in this agreement, any other information through Durbar brochure, notification, published and/ or shall broadcasted by Durbar regarding its services, service price, billing policy, credit policy etc. shall also be binding to this agreement.
Use of Durbar services is subject to its more current applicable usage policies.
Subscriber shall pay agreed charges to Durbar in its prescribed bill format strictly within due date. Durbar have right to suspend or terminate the connection to the subscriber if the bill is not paid in full within due date.
Subscribers shall have to pay “Shifting Charge” for shifting the connection.
Subscriber shall be entitled to reconnect his/her connection by making payment of his/her outstanding in full if the connection of the subscriber has been suspended, temporarily or permanently disconnected due to payment default. If the connection has been permanently disconnected by the Durbar for such circumstances, along with the full payment of the outstanding bill, the subscriber shall also be liable to pay the reconnection fee if applicable.
Durbar will retain the ownership of all optical network equipment provided to the subscriber. In case of termination or temporary stop of services, subscriber shall handover the equipment to Durbar without any delay. For any damages to the equipment, subscriber shall compensate the value of the damage equipment.
Durbar has no control over the accuracy or appropriateness of any information in the internet and the subscriber is solely responsible for the internet usage.
The subscriber undertakes to safeguard the equipment provided by Durbar from potential damage (i.e. misusage, negligence, fire, lightening, natural disaster, theft, sabotage, come in contact with water, drop from height). Durbar shall have the right to ask for damages from the subscriber.
Durbar shall not be liable for any health hazard or problems otherwise caused by the use or abuse of the services and the equipment.
Subscriber shall solely be responsible for his/her own and his/her subscriber’s illegal data or voice transfer or traffic or bulk e-mail spamming or any other illegal operation. The sending of bulk e-mail spamming is strictly forbidden and the subscriber account will be immediately terminated. Subscriber shall indemnify Durbar if it suffers any losses, damages or has to pay any penalty due to unlawful usage of the subscriber.
Subscriber shall install proper electric connection, power grounding UPS, stabilizer etc. in his/her premises and on his/her accord. Subscriber shall not relocate or move any equipment provided by Durbar without the permission of Durbar.
Durbar shall not install any product/ services, without authentic document from the signatory of this document and authorized representative of Durbar and also clearance from the revenue assurance department of the Durbar.
Without customers written request/ consent for any upgrade / downgrade of the bandwidth or any other changes will not be executed. For increasing/ decreasing bandwidth, temporarily/ permanently disconnection needed one month prior written notice.
The subscriber shall file its complain about the services of Durbar to the subscriber customer care.
The subscriber is not authorized to resell Durbar Internet services without written permission and will be liable for legal action to be taken if the subscriber is found in doing so.
Veterans of Bangladesh Armed Forces will be able to enjoy 25% less payment on their monthly charges as a tribute from Durbar Internal on the Golden Jubilee of Bangladesh’s independence for their lifelong service in uniform rendered to the nation! To avail this offer, veterans need to submit their valid TS number at the time of registration or online purchase. Our service delivery team will collect the photocopy of veterans’ ID with TS numbers during connecting their homes with Durbar Internet. Photocopy of the veteran’s ID card is an essential document to activate the especially offered privilege. Veterans can also refer the same to their tenants where a recommendation letter duly signed by the veterans and photocopy of veteran ID will also be considered as an essential document. Durbar Internet exclusively preserves the right to withdraw any offer at any time.
Responsibilities of Durbar are explicitly stated in this agreement as above and Durbar takes no other responsibilities beside those in this agreement.
Notwithstanding anything to the contrary contained herein, Durbar shall not be liable for any reason or any representation, implied warranty or condition or other term, at lawful or under the terms of this agreement for any losses, whether loss/ profit, actual or consequential or otherwise and whether occasioned by the Durbar or its employees or agents or otherwise relating to the sale of the products and/or provision of services to the subscriber.
Durbar reserves the right to change the above terms and conditions.
